Agreement to Terms

PLEASE READ THESE TERMS OF USE ("TERMS") CAREFULLY BEFORE USING THIS WEBSITE.
BY ACCESSING OR USING MONTROSE-REALESTATE.COM (THE "SITE"), YOU ACKNOWLEDGE THAT
YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY THESE TERMS AND
OUR PRIVACY POLICY, WHICH IS INCORPORATED HEREIN BY REFERENCE. IF YOU DO NOT
AGREE TO THESE TERMS, YOU MUST IMMEDIATELY DISCONTINUE USE OF THIS SITE.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and
Montrose-RealEstate.com ("Company," "we," "us," or "our"), a licensed Colorado real estate
brokerage operating at 62470 Ophir Circle, Montrose, Colorado 81403.

Montrose-RealEstate.com is a licensed real estate brokerage regulated by the Colorado Real Estate
Commission (CREC), Division of Real Estate, Colorado Department of Regulatory Agencies

Permitted Use and License

1. Limited License

Subject to your compliance with these Terms, Montrose-RealEstate.com grants you a limited,
revocable, non-exclusive, non-transferable license to access and use this Site solely for your
personal, non-commercial purposes in connection with identifying, researching, buying,
selling, or renting real estate.

This license terminates immediately upon any violation of these Terms.

2. Permitted Uses

You may use the Site to:

  • Browse property listings and real estate information
  • Submit inquiries about properties or brokerage services
  • Contact our licensed brokers
  • Save searches and set up property alert notifications (if registered)
  • Access educational or market information we publish

3. Prohibited Uses

You may not use the Site or any content available through the Site to:

  • Copy, reproduce, distribute, display, or create derivative works from Site content without prior written consent
  • Scrape, crawl, index, or harvest data from the Site through automated means
  • Use MLS/IDX listing data for any commercial purpose or any purpose other than identifying prospective properties for personal purchase or rental
  • Frame, mirror, or embed the Site or its content on any other website without express written consent
  • Use the Site for any unlawful purpose or in violation of any applicable law or regulation
  • Transmit any unsolicited commercial communications, spam, or malware
  • Attempt to gain unauthorized access to any part of the Site, our servers, or connected systems
  • Circumvent, disable, or interfere with security features of the Site
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Violate the rights of any third party, including copyright, trademark, privacy, or other personal or proprietary rights

MLS and IDX Listing Data

1. IDX Data Disclaimer

This Site may display property listings obtained through an Internet Data Exchange (IDX) feed
from one or more Multiple Listing Services (MLS) to which Montrose-RealEstate.com participates.
All IDX listing data is provided for consumers' personal, non-commercial use only, and may
not be used for any purpose other than to identify prospective properties consumers may be
interested in purchasing.

2. Data Accuracy

All listing information is deemed reliable but is not guaranteed accurate by the MLS or
Montrose-RealEstate.com. Property information, including pricing, availability, square footage, lot
size, features, and other details, is obtained from third-party sources and may contain errors,
omissions, or may have changed since the listing was last updated.[ 7]
You are strongly encouraged to independently verify all property information through
personal inspection and consultation with appropriate professionals (e.g., appraisers,
inspectors, attorneys) before making any real estate decision.

3. MLS Attribution and Copyright

All MLS listing data displayed on this Site is the copyrighted property of the applicable MLS and
its participants. Listings must be attributed to the listing broker as required by MLS rules. The
MLS is the source of all listing data displayed pursuant to IDX rules.

4. Listing Updates

Listing information is refreshed from the MLS feed no less frequently than every 12 hours in
compliance with applicable MLS IDX rules. Montrose-RealEstate.com makes no representation
that listings are updated in real time. Properties displayed may be under contract, sold, or
withdrawn since the last data refresh.

5. Prohibited Use of Listing Data

You may not:

  • Use IDX listing data for any commercial purpose
  • Redistribute, retransmit, or republish listing data to any third party
  • Combine MLS data with other data sources for the purpose of creating a competing database
  • Remove or alter any copyright, trademark, or other proprietary notices from listing data

Intellectual Property

1. Our Content

All content on this Site that is not MLS/IDX data — including but not limited to text, graphics,
logos, photographs, videos, page layouts, and software — is owned by or licensed to
Montrose-RealEstate.com and is protected by applicable United States and Colorado copyright,
trademark, and other intellectual property laws.

2. Trademarks

"Montrose-RealEstate.com" and our associated logos are trademarks or trade names of our
brokerage. The REALTOR® mark and related logos are registered marks of the National
Association of REALTORS® and may only be used by members. You may not use our trademarks
or trade names without our prior written consent.

3. User Submissions

If you submit any content to us through the Site (e.g., via contact forms, reviews, or comments),
you grant Montrose-RealEstate.com a non-exclusive, royalty-free, perpetual license to use,
reproduce, and display such content in connection with our brokerage services. You represent
that you have all necessary rights to grant this license and that your submission does not
infringe the rights of any third party.

4. DMCA — Copyright Infringement Notice

any modification constitutes your acceptance of the updated Terms. We encourage you to

Severability and Waiver
